Tribunal Procedures

The following outlines the process of Appealing decisions of the Authority to the Land Transport Appeals Tribunal.

PROCEDURE

1. Once a decision has been made by the Authority, the aggrieved parties if they so want, may lodge an appeal via a Notice of Appeal with the Secretary to the Tribunal no later than 14 days after the date of the decision.

2. The Appellant shall pay the application fee of $27.27 (VEP) at the time of lodgement of the appeal and such fee shall be forfeited in the event the appeal is dismissed.

3. The appeal should be filed at the Land Transport Appeals Tribunal Registry in the respective jurisdiction(s).

4. The Tribunal shall as soon as practicable after the receipt of the appeal do the following:
(a) fix a time and place for the hearing of the appeal; and
(b) cause notice of the time and place of the hearing of the appeal to be given to the Appellant, to the Authority and to any other interested person involved in the application or objectors to the original application the decision on which gave rise to the appeal.

5. The Tribunal Secretary shall within 28 days after the date on which the Notice of Appeal is lodged, notify the Appellant and any other interested party of the time and place of hearing.

6. The Authority must ensure that a Certified Copy Record is filed with the Tribunal within 21 days of the Notice of Appeal being served on the Authority.

7. Where more time is required by the Authority, proper application must be made to the Tribunal at the time the matter is called before the Tribunal.

8. The Tribunal may give further directions and or set a date for the Hearing of the Appeal.

9. Once a decision has been made by the Tribunal a copy of the ruling shall be given to the parties either on the date of ruling or can be obtained from the Tribunal Secretary. If ruling is given verbally then parties can seal an order by filing with Tribunal and serving same to other parties.

10. No appeal shall lie to the Tribunal from a decision of a delegate of the Authority unless that decision has been confirmed or otherwise dealt with by the Authority pursuant to section 12(7) of the Land Transport Act 1998.

APPLICABLE DOCUMENTS

The Notice of Appeal must contain the following:

*Name of the Appellant;
*Residential address, phone, fax and email address
*LTA file number quoted in the decision letter.
*List of parties affected (Interested parties)
*The type of permit you had applied for (Taxi, Minibus, Carrier, RRL etc);
*The date of application;
*The decision of the Authority;
*The Grounds of Appeal
